Using Kuttle means accepting these terms
These Terms of Service ("Terms") are an agreement between you and Kuttle ("Kuttle," "we," "us," or "our") covering the Kuttle website, desktop application, beta releases, and related services (together, the "Service"). By downloading, installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old or the age of legal majority where you live and able to form a binding contract. If you use Kuttle for an organization, you represent that you have authority to accept these Terms for it.
If you do not agree, do not use the Service.
02 / The service
A desktop action surface, currently in beta
Kuttle helps you direct AI models and approved tools across apps, files, websites, and desktop actions. Features may include context capture, text and image generation, file and Office actions, email drafting or sending, web requests, automations, agent memory, and locally stored task history.
Beta notice. The Service is pre-release software. It may be incomplete, contain errors, lose local configuration, change without notice, or stop working with an operating system, provider, app, or tool. Do not use the beta as the only copy of important information or for a task where failure could cause serious harm.
We may add, change, limit, suspend, or discontinue any feature. We do not promise that a beta feature or proposed plan will reach general availability.
03 / Your license
A limited right to use Kuttle
Subject to these Terms, Kuttle grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the application for lawful internal personal or business purposes during the beta.
This license does not transfer ownership of the Service or its design, code, trademarks, or other intellectual property. Open-source components are licensed under their applicable licenses, which control if they conflict with these Terms.
04 / Your responsibility
You are responsible for the actions you authorize
You control what context Kuttle can access and which actions it may perform. You agree to:
- provide only data, files, accounts, and systems you are allowed to use;
- review the command, context, capability, destination, and output before approving a consequential or externally visible action;
- maintain appropriate backups and independent controls for important files and systems;
- secure your computer, operating-system account, provider keys, integration credentials, and Kuttle configuration;
- comply with law, professional duties, workplace rules, and third-party terms;
- promptly revoke exposed credentials and tell us about suspected vulnerabilities in the Service.
You are responsible for commands submitted through your installation and for the results of actions you approve, including messages sent, files changed, tools run, purchases made, or content published.
05 / Third parties
Providers and tools have their own terms
Kuttle can connect to third-party model providers, websites, email services, applications, APIs, automations, and tools. They are not controlled by Kuttle. Your use of them is governed by your agreement with each provider, including its data use, acceptable use, fees, rate limits, and output terms.
You are responsible for obtaining provider accounts and API keys and for all provider charges incurred through them. Kuttle is not responsible for third-party availability, accuracy, security, content, policy changes, or charges.
Installed or generated tools may execute code and interact with local or external resources. Review a tool's source, publisher, manifest, dependencies, and requested permissions before enabling it. A sandbox or permission prompt reduces risk but does not eliminate it.
06 / Content and intellectual property
Your content remains yours
As between you and Kuttle, you retain your rights in commands, files, context, tool inputs, and other material you provide ("Input"). Subject to third-party provider terms and applicable law, you own output generated for you to the extent it can be owned.
You give Kuttle a limited permission to access, process, reproduce, transmit, and modify Input and output only as needed to provide, secure, and troubleshoot the Service or comply with law. This permission ends when it is no longer needed for those purposes.
You represent that you have the rights and permissions required for your Input and your requested use of output. AI output may not be unique, may resemble output provided to others, and may not qualify for intellectual-property protection.
Feedback
If you voluntarily give us product feedback, you allow us to use it without restriction or compensation. This does not give us ownership of your unrelated content or confidential information.
07 / Restrictions
Do not use Kuttle to harm people or systems
You may not use the Service to:
- violate law or another person's privacy, publicity, contractual, or intellectual-property rights;
- access an account, device, file, network, or service without authorization;
- create or distribute malware, evade security controls, disrupt services, or facilitate fraud, harassment, exploitation, or deception;
- submit secrets, personal data, or confidential material when you lack authority or a lawful purpose;
- make fully automated high-impact decisions about a person's employment, housing, credit, insurance, education, legal rights, or medical care;
- rely on output as a substitute for qualified legal, medical, financial, safety, or other professional judgment;
- remove proprietary notices, misrepresent Kuttle's origin, resell the beta, or circumvent technical limitations, except where law expressly permits reverse engineering despite this restriction.
08 / Ending use
You can stop using Kuttle at any time
You may stop using the Service and uninstall the application at any time. Remove local settings, keys, agent files, tools, history, and artifacts separately if you also want those deleted.
We may suspend or terminate access to a service we operate if you materially breach these Terms, create risk or legal exposure, or if the Service is discontinued. When reasonably possible, we will provide notice and an opportunity to export or remove data we hold.
Terms that by their nature should survive termination—including ownership, disclaimers, limits of liability, and general legal terms—will survive.
09 / Risk and liability
AI and desktop actions require verification
Models can produce inaccurate, incomplete, offensive, insecure, or outdated output. Context detection can be wrong. Tools can fail. Actions can modify files or communicate externally. You must evaluate output and use human review appropriate to the risk before relying on it.
No warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Kuttle disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, availability, and that errors or data loss will not occur.
Limit of liability
To the maximum extent permitted by law, Kuttle and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption arising from the Service.
To the maximum extent permitted by law, Kuttle's total liability for all claims relating to the Service will not exceed the greater of the amount you paid Kuttle for the Service during the 12 months before the event giving rise to the claim or US $100.
Some jurisdictions do not allow certain warranty disclaimers or liability limits. In those places, these provisions apply only to the extent allowed, and your non-waivable consumer rights remain unaffected.
10 / General terms
The complete agreement
These Terms and the Privacy Policy are the entire agreement between you and Kuttle about the Service and replace prior discussions on that subject. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. A delay in enforcing a provision is not a waiver.
You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets. Neither party is liable for delay caused by events beyond reasonable control.
Any dispute will be subject to the mandatory laws and courts that have lawful jurisdiction. Nothing in these Terms removes consumer protections or dispute rights that cannot legally be waived.
Changes
We may update these Terms as the Service changes. We will post the revised Terms and effective date here. For material changes, we will provide additional notice when reasonably possible. Continuing to use the Service after the new Terms take effect means you accept them.
